Italy’s Corte di Cassazione has confirmed that a condominium assembly cannot ban short-term rentals by majority vote. An STR restriction is valid only when it appears in a regolamento condominiale contrattuale (contractual condominium regulation) with a clear and unequivocal clause, duly transcribed or referenced in every owner’s purchase deed.
