Catalonia Anti-Speculation Law Ruled Unconstitutional
The Catalan Consell de Garanties Estatutàries unanimously ruled the Govern-Comuns anti-speculation purchase law unconstitutional on 4 August 2026. The verdict, though non-binding, is politically devastating for a housing agenda that also drives STR restrictions. The Govern has pledged to rewrite the law.

The Catalan Consell de Garanties Estatutàries (CGE) unanimously ruled on 4 August 2026 that the Govern-Comuns anti-speculation housing law violates the Spanish Constitution. The law would have given the Catalan Government a right of first refusal on property purchases in tensioned zones, but the CGE found it breaches property rights, freedom of enterprise, and legal security. The Govern immediately announced it will modify the law (La Vanguardia, 5 August 2026).
