France Mandates Anti-Airbnb Clause in New Leases
Every residential lease signed or renewed in France from 1 October 2026 must include a primary-residence servitude clause in PLU-designated zones, blocking tenants from listing on Airbnb. Landlords face a compliance scramble across their lease templates.
From 1 October 2026, every landlord in France who signs or renews a residential lease in a zone where the local urban plan (PLU) designates exclusive primary-residence use must include a clause that forbids the tenant from listing the apartment on Airbnb or any short-term rental platform. The obligation comes from Décret n° 2026-596, published in the Journal Officiel on 7 July 2026, and amends the standard lease contracts for unfurnished rentals, furnished rentals, and shared tenancies (Légifrance, 7 July 2026). If a tenant violates the clause, the mayor can issue a formal notice backed by fines of up to €1,000 per day (Koliving, 11 July 2026).
