France Validates €8.6M Airbnb Tourist-Tax Fine
The Conseil constitutionnel ruled on 31 July 2026 that per-night tourist-tax fines of €750–€2,500 against platforms are constitutional. France’s Conseil constitutionnel validated the per-night tourist-tax fine structure that underpinned Airbnb’s €8.6 million penalty, ruling on 31 July 2026 that fines of €750 to €2,500 per night per violation are constitutional. The court rejected Airbnb’s argument that cumulative fines without a statutory cap violated the proportionality principle of the Declaration of the Rights of Man. Every French municipality now has a constitutionally secured legal path to pursue platforms for uncollected or late-paid taxe de séjour.
