Paris commercial-Airbnb ban upheld by France's top court
The Conseil d'État ruled that Paris can block commercial-to-STR conversions using qualitative criteria alone. No automatic right exists to convert a vacant ground-floor shop into a meublé de tourisme.

France’s highest administrative court has validated Paris’s power to block the conversion of commercial premises into short-term rentals. The Conseil d’État, ruling on 15 July 2026 (decision n° 503274), overturned a February 2025 appeals court judgment that had partially struck down the city’s December 2021 regulation. The bottom line for operators: converting a ground-floor shop into an Airbnb in Paris is not an automatic right, even if the commercial unit sits vacant.
