Tuscany STR model green light: what it means for Lombardy
Tuscany's Testo Unico, confirmed by Italy's Constitutional Court, gives municipalities STR zoning and density powers. Lombardy has not yet adopted a similar law, but the legal path is now clear.

Italy’s Constitutional Court has confirmed Tuscany’s Testo Unico Turismo, giving municipalities the power to zone and density-limit short-term rentals. The ruling sets a national precedent that Lombardy could follow, and Milan operators should track whether the region introduces similar legislation.
What changed
- The Constitutional Court (sentenza 186/2025) confirmed Tuscany’s L.R. 61/2024 giving municipalities STR zoning powers
- Tuscany can now require extra-hotel structures to operate in imprenditoriale (business) form
- Municipalities with high tourist density can adopt regulations setting criteria and limits in specific zones (Art. 59)
- Lombardy has not introduced a comparable regional law, but the constitutional barrier is now removed
- Milan operators should watch for Lombardy to adopt Tuscany-style STR regulation
