The Tribunal Superior de Justicia de Madrid (TSJM) has annulled seven fines imposed by the Ayuntamiento de Madrid against VUT operators for lacking independent street access. The court found that the City misclassified the infraction — treating a failure to meet an implantation condition as a “grave infringement” under urban planning law, when the law does not authorise that penalty. The ruling opens a clear path for every operator who has been fined under this classification to challenge their sanction.
